1. About PicToList

PicToList ("we," "us," or "our") operates the Flippy SMS resale assistant service available at pictolist.com and via SMS at (213) 444-7151. By using our service, you agree to these Terms of Service.

PicToList provides AI-generated item identification, pricing suggestions, and listing descriptions via SMS to help users sell personal items on third-party platforms.

2. SMS Messaging & Consent

Our SMS program works as follows:

• Messages are sent only in direct response to messages you send us
• We do not send unsolicited promotional SMS blasts
• Message frequency varies based on your usage
• Standard message and data rates from your mobile carrier may apply

To opt out at any time, reply STOP to any message. You will receive one final confirmation and no further messages will be sent. To re-subscribe, text START again.

3. Service Description

PicToList's Flippy assistant uses artificial intelligence to:

• Identify items from photos you send via SMS
• Research comparable sold listings on third-party resale platforms
• Generate suggested listing titles, descriptions, and price recommendations

All pricing suggestions are estimates based on publicly available sold listing data and are not guarantees of sale price or outcome. You are solely responsible for the accuracy of listings you post and any transactions you enter into with buyers.

4. Free Tier & Paid Plans

PicToList offers:

• Free tier: 3 listing generations at no charge. No credit card required.
• Starter Pack: $4.99 for 10 listing generations
• Pro Pack: $12.99 for 35 listing generations
• Flippy Pro: $19.99/month for 75 listing generations, plus $0.25 per additional generation

All purchases are processed securely through Stripe. Credits do not expire. Subscription plans renew monthly and can be cancelled at any time by replying CANCEL to any message or contacting support@pictolist.com.

5. Acceptable Use

You agree not to use PicToList to:

• List illegal, counterfeit, stolen, or prohibited items
• Generate listings for items you do not own or have the right to sell
• Attempt to reverse-engineer, scrape, or abuse our AI systems
• Send spam, abusive, or harassing messages to our service

We reserve the right to suspend or terminate access to users who violate these terms.

6. Third-Party Platforms

PicToList is not affiliated with, endorsed by, or partnered with Facebook, eBay, Mercari, Craigslist, or any other resale platform. Listings generated by Flippy are intended to be posted by you on those platforms subject to each platform's own terms of service. We are not responsible for any transactions, disputes, or outcomes that occur on third-party platforms.

7. Disclaimer of Warranties

PicToList is provided "as is" without warranties of any kind. We do not guarantee that AI-generated listings will result in sales, that pricing suggestions will be accurate, or that the service will be available without interruption. Use of the service is at your own discretion and risk.

8. Limitation of Liability

To the fullest extent permitted by law, PicToList shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to lost profits or failed sales.

9. Privacy

Your use of PicToList is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes are posted constitutes acceptance of the revised Terms. We will always post the most current version at pictolist.com/terms.

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in the courts of Los Angeles County, California.
